§ 95.16 BACK FILLING OF OPENINGS.
   (A)   All openings made in any street or sidewalk under the provisions of this subchapter shall immediately, upon completion of the work, be filled in and the surface thereof made flush with the adjacent surface.
   (B)   Any hard surface, macadam or asphalt removed shall be replaced by the town at the expense of the applicant granted permission to open such street or sidewalk.
   (C)   Prior to making any open cut of town roads or streets, the contractor shall have all underground utilities located and obtain written approval from the Zoning Administrator.
   (D)   Any utilities installed under a town street shall be placed within a carrier pipe with the trench being no less than 18 inches deep. After place of the carrier pipe, the area around the pipe shall be backfilled to a depth of six inches above the crown of the pipe. This backfill shall be compacted to 95% of modified proctor. The remainder of the trench shall be backfilled and compacted in eight-inch lifts to 95% modified Proctor. The top eight inches shall be asphalt binder course Type H or HB and the surface shall be two inches of asphalt, Type I-1 or I-2.
   (E)   Any utilities installed under a town sidewalk shall be placed in a carrier pipe and backfilled in accordance with division (D) above, and the surface replaced to match the pre-existing surface.
