§ 70.08 UNMUFFLED ENGINE COMPRESSION BRAKES.
   (A)   It shall be unlawful for any person to operate or cause to be operated a motor vehicle within the corporate limits of the town unless the exhaust system is free from defects affecting sound reduction.
   (B)   It shall be unlawful for any person to operate or cause to be operated a motor vehicle within the corporate limits of the town when the exhaust system of the motor vehicle has been removed, modified such that sound emission has been increased, the muffler cut-out or the muffler bypassed.
   (C)   It shall be unlawful for any person to operate or cause to be operated a motor vehicle within the corporate limits of the town using an unmuffled engine compression brake.
   (D)   This section shall not apply to emergency driving situations requiring the utilization of an engine compression brake to protect the safety and property of the general public, the motor vehicle operator or pedestrians.
