Prior to the commencement of any construction work, the franchisee shall file both a construction and performance bond in an amount approved by the city in favor of the city and any other person who may suffer damages as a result of the breach of any duty by the franchisee assured by such bond. Such bond as contemplated herein shall be in a form approved by the city and shall, among other matters, cover the cost of removal of any property of the franchisee. In no event shall the amount of the bond be construed to limit the liability of the franchisee for damages. The city, at its sole option, may waive this requirement, or permit the consolidation of the construction bond with the performance bond.
