(A) Commissioner of Public Services shall oversee the permitting of rental dwellings. The commissioner of Public Services shall have the duty to review all submitted rental property registration applications and issue permits for operating rental dwellings to those owners whose applications are accepted. Issuance of permits shall be within the sole discretion of the Commissioner of Public Services, based upon the information provided in the rental property registration application. The Commissioner of Public Services is authorized to delegate the responsibility of reviewing applications, but cannot delegate the responsibility of issuing permits for qualified applicants.
(B) Within 30 days of the city's receipt of a rental property registration application (or re- registration), along with the registration fee, the Commissioner of Public Services shall either issue the owner a permit to operate the rental property, or, if the Commissioner decides not to issue the permit, the Commissioner shall provide a written list of deficiencies or violations that must be corrected before a permit may be issued.
(C) If the owner contests the permit denial, the owner may appeal the denial to a panel comprised of all of the City Commissioners. The appeal must be filed within 20 days of the receipt of the denial by owner. The appeal will be heard by all of the City Commissioners at the next regular meeting, at which time the owner may present evidence relevant to whether the property is in compliance with all City of Bancroft ordinances, as well as Metro Louisville ordinances, and any other relevant evidence disputing any other reason for denial enumerated by the Commissioner of Public Services in the list of deficiencies provided with the denial.
