(A) Application of provisions to city and three- mile radius. The provisions of this subchapter shall apply to all industrial and commercial structures and additions thereto added to real property and located within the corporate limits of the city and all such structures and additions located within three miles of the corporate limits of the city.

(B) Eligibility.
(1) No new structure or addition shall qualify for the assessed valuation formula described in this subchapter unless the property is in continuous compliance with all applicable environmental and air and water quality rules, regulations, laws, and standards that are now in effect or may hereafter be in effect.
(2) This subchapter shall apply to those eligible structures or additions erected or partially erected as of the date of assessment on January 1, 2006.
