§ 93.35 PRIMARY RESPONSIBILITY; CITY JURISDICTION.
   (A)   Primary responsibility. Every owner and inhabitant of private property within the city shall be responsible for the proper maintenance, care, and pruning of all trees on private property within the city, and, when necessary, the removal of dead, diseased, or otherwise dangerous trees or parts thereof on private property within the city.

   (B)   City jurisdiction. The city shall have the jurisdiction and authority to order, and if necessary, to be involved in the actual pruning, care, removal, or other activity involving any trees on any private property when the same shall be deemed necessary or advisable to preserve the public health, peace, safety, or welfare, or to prevent the spread of disease or insect infestation to other trees, plants, or animals.
