§ 150.02  RESIDENCES IN BUSINESS DISTRICT.
   (A)   For purposes of this section, the “business district” of the city is defined as that area comprised of the city’s downtown main street known as Market Street, including the alleyways on each side of said street, between First and Fourth Streets.
   (B)   Except as allowed by this section, no person shall reside, occupy or use any building, lot or area within the business district as a personal residence.
   (C)   A single-family residence may be maintained within the business district only if the following terms and conditions are met:
      (1)   The single-family residence is located within a building currently used to conduct a business which is open to the general public.
      (2)   The single-family residence must be used by the person or family actually conducting the business at the subject location.
      (3)   The single-family residence and the business being conducted at the subject location must comply with all ordinances, codes and other governmental laws regulating and/or affecting residences, business structures and dwellings.
   (D)   (1)   The City Marshal and/or Fire Chief, or their designees, are charged with the duty of enforcing this section.
      (2)   The enforcing officer may seek the assistance of all other city departments or other regulatory agencies to effectively enforce the terms of this section.
