(A) Council is the governing body of the town and, as such, is empowered to enact such policies and ordinances as shall appear necessary and proper in order to provide for the health, safety and general welfare of the citizens and community of the town. The town, through the Department, is the legal entity authorized to provide for the water distribution needs of the town.
(B) Council consists of representatives elected by residents of the town and is thereby charged with the primary responsibility of promoting and providing for the best interests of the citizens and community of the town, and of good government. Council recognizes that sanitary water distribution service in the town as a matter of concern, especially with respect to fiscal restraints, cost effectiveness, health, population growth and environmental impacts.
