(A) It shall be unlawful to dump, deposit or otherwise cause any trash, landscape debris or other material to be placed within drainage easements or rights-of-way under maintenance by and located within incorporated limits of the town into any drainage channel, pond or basin which regularly or periodically carries or stores stormwater.
(B) The town shall be responsible for enforcement of this section. A violation of the foregoing shall be a second degree misdemeanor and shall be punishable by law. In the event the town deems it necessary to bring civil action to enforce the terms of this section, the violator shall be responsible for all court costs and attorney fees incurred by the town.
