This section is intended to impose an impact fee for the acquisition and improvement of public recreation facilities on the development of those single-family, and multiple-family dwelling units identified in Section 1217.02 of this Code. In enacting this Code the Council acknowledges that the City is responsible for and will meet, through the use of general City revenues, the reasonable capital improvements and maintenance requirements of the City's existing recreation facilities. The recreation impact fees authorized by this section will be used solely for the acquisition and improvement of the additional public recreation facilities required to meet the need for such facilities created by new development and (a) Such fees shall not exceed the cost of acquisition and improvement of those public recreation facilities the need for which is reasonably attributable to those developments that pay the fees; and (b) The fees shall be spent solely for the acquisition and improvement of additional public recreation facilities that substantially benefit those developments that pay the fees.
