§ 72.99 PENALTY.
   A violation of any provision of this chapter shall constitute a violation of the Avilla Town Code. An owner, lessee or operator may be cited to appear in a court of competent jurisdiction by issuance of an Indiana Uniform Traffic Ticket. Upon a finding by such court that an owner, lessee or operator of a golf cart has violated any provision of this chapter, such person shall be subject to a fine not to exceed $200 for each offense together with court costs. Provided however, that the person violating this chapter may admit the violation before the Avilla Ordinance Violation Bureau. In such cases a person will be fined a fine of $25 for the first offense, a fine of $50 for the second offense within 365 days of the commission of the first offense, and $100 for the third offense, provided the same is committed within 365 days of the first offense. In the event the person does not admit the violation within ten days of the issuance of the citation therefor, or if the person shall deny the violation of the chapter, or if the violation is the fourth or subsequent violation within 365 days of the first offense, the violator will be prosecuted in the manner the ordinances are customarily enforced.
