§ 34.03 VACATION.
   (A)   Employees earn vacation as of the first of each year, as follows:
      (1)   After probationary period: l week.
      (2)   After one full year of employment: 2 weeks.
      (3)   After five full years of employment: 3 weeks.
      (4)   After fifteen full years of employment: 4 weeks.
   (B)   The said vacation time so earned by said employee can be accumulated if not utilized during the year for which it is designated and carried over to the following year, with the exception that no more than 25 days can be accumulated at any time. If an employee accumulates the 25 days maximum and does not utilize any of the days, the employee will forfeit any forthcoming days, keeping the total number of days at 25.
   (C)   No employee shall be permitted to work and at the same time draw vacation pay, it being the intention hereof that vacation shall be paid only during the periods when the employee is not engaged in work for the town.
   (D)   The Town Council may, but shall not be required to grant an advance on vacation time to be earned in the current work year. No advances on vacation time earned in future work years shall be granted.
   (E)   Notwithstanding the fact that employees are entitled to vacation time, the specific timing of said vacation for any individual employee is subject to the prior approval of the Town Council or if so designated then by the department head of said employee. A vacation request can be denied by the Town Council if it is shown that a leave at such time would be detrimental to the efficiency of the town.
   (F)   Accumulation of vacation time for permanent part-time employees is the equivalent of one- half of said time set forth in this section for full-time employees and payment of same shall be at the same rate as said employee was earning immediately prior to taking of said vacation.
   (G)   Vacation days set forth in this section can be taken on a one-hour basis, a one-day basis, weekly basis, or the entire amount of accumulated days at one time pending the approval from the Town Council or department head.
   (H)   For purposes of this section, an employee shall be a person defined in § 34.01.
