§ 93.46  PROHIBITING SCAVENGING OF RECYCLABLES.
   (A)   (1)   The city has adopted the goal and joined the effort to reduce the quantity of municipal solid waste through various means including source reduction and recycling.
      (2)   The city intends to participate by contract in a recycling effort to reduce the quantity of municipal solid waste disposed in landfills.
      (3)   The public benefit of course separation and solid waste management would be significantly impaired if recyclable items of value were removed form the waste stream.
   (B)   When recyclables are placed at curbside for recyclables collection, within the corporation boundaries of the city, said recyclables then become subject to the control of the city.
   (C)   After recyclables are placed at curbside for recyclables collection, only the contractor authorized by the city to collect the recyclables shall be permitted to take possession of the recyclables from curbside. All other persons are prohibited from scavenging and taking recyclables from the curbside collection location.
