§ 96.02  DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   COMMERCIAL AREA. Land primarily being used as office, governmental, retail or other commercial type uses.
   INDUSTRIAL AREA. Land primarily being zoned as a manufacturing or industrial site, including airports.
   MOTOR VEHICLE. Any vehicle which is propelled or drawn on land by a motor, such as, but not limited to, passenger cars, trucks, truck-trailers, semi-trailers, campers, go-carts, snowmobiles, amphibious craft on land, dune buggies or racing vehicles, but not including motorcycles.
   MOTORCYCLE. An unenclosed motor vehicle having a saddle for the use of the operator and two or three wheels in contact with the ground, including, but not limited to, motor scooters, mini-bikes and motor-driven cycles.
   NOISE CONTROL OFFICER. The Chief of Police and his or her agents who have lead responsibility for the enforcement of this chapter.
   NOISE DISTURBANCE. Any sound which either exceeds the maximum permissible sound levels of this chapter or which endangers or injures the safety or health of humans or animals, annoys or disturbs a reasonable person of normal sensitivities, or endangers or injures personal or real property.
   NOISE SENSITIVE ZONE. Areas in the city which contain noise sensitive activities, such as schools, libraries, churches, hospitals and nursing homes, as designated by ordinance of the City Council.
   REAL PROPERTY BOUNDARY. The imaginary line which represents the legal limits of property (including an apartment, condominium, room or other dwelling unit) owned, leased or otherwise occupied by a person, business, corporation or institution. In cases involving sound from an activity on a public street or other public right of way, the REAL PROPERTY BOUNDARY shall be the nearest boundary of the public right-of-way.
   RESIDENTIAL AREA. Land zoned for one, two or more family dwelling(s) and located adjacent to or near other residentially zoned land.
