§ 94.22  NEW CONSTRUCTION AND ADDITIONS.
   In accordance with the statutes of the State of Nebraska, including Neb. RS 17-130, 17-131, 17-132, 17-136, 17-137, 17-505, 17-549 and 17-550, it shall be unlawful for any person, persons, company or corporation to build, erect, construct or cause to be built, erected or constructed any wooden or other combustible building or part thereof or to enlarge any building or to build any addition thereto within the fire zone, except as allowed herein.
   (A)   Building requirements. Every building hereafter erected or enlarged within the fire zone shall be enclosed on all sides with wall constructed wholly of stone, well-burned brick, terra cotta, concrete or equivalent noncombustible materials; provided that non-bearing interior walls, roofs and dormer windows on masonry buildings may be constructed with wood joists or studs, but the roofs and dormer windows, shall, in all cases, be covered with noncombustible material, with tin, iron, slate, tile or fire proof roof; provided further, noncombustible materials may be construed to include wood when applied to floors in any building within the fire zone. All cornices shall be noncombustible material, and provided further that a wood veneer of not less than one inch nominal thickness or exterior type plywood or particle board not less than three-eighths inch nominal thickness may be applied to walls fronting on streets or yards which walls are constructed of noncombustible materials, the wood shall be placed either directly against the noncombustible surfaces or furred out from those surfaces not to exceed one and five-eighths inches with all concealed spaces fire stopped.
   (B)   Minor repairs. Minor repairs on existing wooden or iron clad structures, such as to stop leaky shingle roofs, siding on existing warehouses or storage sheds, where the work might be fairly construed as patching or covering small areas on the outside or inside of combustible buildings, shall not require fireproof materials.
   (C)   Roofing. When combustible buildings are permitted to be roofed or reroofed in the fire zone, roof covering over all combustible roof construction shall be either of the following kinds:
      (1)   Composition roofings bearing the label and laid in the manner provided by the Underwriters Laboratory, Inc., for Class A and B;
      (2)   Concrete slab or concrete tile;
      (3)   Slate;
      (4)   Clay;
      (5)   Tile; or
      (6)   Asphalt.
