(A) The property owner may appeal the Destruction Order by filing written notice of objections with the enforcement authority and Clerk-Treasurer within 48 hours of the notice, excluding weekends and holidays, if the property owner contests the finding of the enforcement authority. It is the property owner’s responsibility to demonstrate that the matter in question is shrubs, trees, cultivated plants or crops, or is not otherwise in violation of this subchapter, and should not be subject to destruction under the subchapter.
(B) An appeal by the property owner shall be brought before the Aurora City Hearing Officer and shall be decided by the Aurora City Hearing Officer. The Hearing Officer’s decision may be appealed before the Aurora City Council by giving written notice of appeal to the Aurora City Council within ten days of the Hearing Officer’s decision.
