§ 31.078  CITY ZONING COMMISSIONER.
   (A)   (1)   A Zoning Commissioner shall be appointed who shall serve as chief zoning official and building inspector for the city. The Zoning Commissioner shall perform such duties and have such powers as are provided for that office by ordinance and by the laws of the state. It shall be the duty of the Zoning Commissioner to administer and enforce all ordinances, codes, standards, rules and regulations relating to buildings and utility installation and to zoning and subdivisions. The Zoning Commissioner shall investigate all complaints, whether they are verbal, written or in the form of a petition, alleging and charging the violation of any ordinance, code, standard, rule or regulation relating to buildings, utility installation, zoning or subdivisions. The Zoning Commissioner shall keep records of all complaints received, inspection reports, orders and complaints issued and shall prepare an annual report to the City Council including statistics based upon the records. The records shall be available for public inspection. It shall be the duty of the Zoning Commissioner to make reports and perform duties as the City Council shall direct.
      (2)   It shall be the duty of the Zoning Commissioner to conduct surveys and make inspections within the jurisdiction of the city in order to determine whether all buildings and structures are in compliance with all ordinances, codes, standards, rules and regulations relating to buildings and utility installation and to zoning and subdivisions. The Zoning Commissioner shall, in the discharge of his or her official duties and upon proper identification of his or her official capacity, have the authority pursuant to this section to enter into any building, structure or premises in the city at any reasonable hour for the purpose of inspection. The inspection shall be carried out as provided by the laws of the state, including, but limited to, Neb. RS 29-830 through 29-835, inclusive, as amended or superseded. In the event that the Zoning Commissioner shall discover a violation of the provisions of any ordinance, code, standard, rule or regulation relating to buildings, utility installation, zoning or subdivisions, it shall be the duty of the Zoning Commissioner to notify, in writing, the person, firm or corporation responsible for the violation, indicating the nature of the violation and ordering the actions necessary to correct it. The notice shall include appropriate orders for the discontinuance of illegal use of land, buildings or structures, the repair, rehabilitation or demolition and removal of buildings, structures, additions, alterations or structural changes which are illegal or unsafe and a public nuisance and the discontinuance of any illegal work being done upon any land, building or structure. It shall be the duty of the Zoning Commissioner to take any action, authorized by ordinance and by the laws of the state, necessary to ensure compliance with or prevent violation of all ordinances, codes, standards, rules and regulations relating to buildings and utility installation and to zoning and subdivisions.
      (3)   The Zoning Commissioner shall have the power to require the City Electrical Inspector and the City Plumbing Inspector to assist him or her in the execution of his or her duties, as defined by ordinance and by the laws of the state.
      (4)   The Zoning Commissioner shall have no financial interest in the furnishing of labor, materials or appliances for any building or structure within his or her jurisdiction, except where he or she is the owner of the building or structure, neither shall the Zoning Commissioner act as an agent for any dealer of the labor, materials or appliances. The Zoning Commissioner shall not act as an agent for the sale, lease or rental of any real estate within his or her jurisdiction.

   (B)   A Zoning Commissioner shall be appointed who shall be the chief zoning official of the city. It shall be the duty of the Zoning Commissioner to administer and enforce the zoning and subdivision laws of the city. In the event that the Zoning Commissioner shall find that any provisions are being violated, he or she shall notify in writing the person responsible for the violations, indicating the nature of the violations and ordering the actions necessary to correct them. He or she shall order the discontinuance of illegal use of land, buildings or structures, the removal of illegal buildings, structures, additions, alterations or structural changes and the discontinuance of any illegal work being done and shall take any other action authorized by ordinance and by the laws of the state to ensure compliance with or prevent violation of the zoning and subdivision laws of the city.
