For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
IMMEDIATE CONTROL. (The following definition shall apply for purposes of §§ 98.028, 98.029 and 98.069.) A higher degree of control than the word “control”. To hold in physical restraint. To have IMMEDIATE CONTROL, the owner, keeper or harborer of the animal must be physically present and exercising physical restraint on the animal.

OWNER. Any person possessing, keeping, harboring or having charge or control of, or permitting any dog or cat to habitually be or remain on, or be lodged or fed within, the person’s house, yard or premises. A dog or cat shall be deemed to be “harbored” if it is fed or sheltered five consecutive days or more.
