§ 70.036  POSSESSION OF ALCOHOLIC LIQUOR IN UNSEALED CONTAINER.
   It shall be unlawful for any person to carry, transport or possess any alcoholic liquors, as defined by Chapter 114 of this code, in any unsealed or open container upon the city parks, public sidewalks, streets, alleys, parking areas, roads or highways; provided, however, that, nothing herein shall be construed to prohibit the carrying or transportation of alcoholic liquors in unsealed or open containers by motor vehicle, so long as the container is not carried or transported within the passenger compartment of the vehicle; or within any compartment of the vehicle designed for the carrying of passengers or at any location, either in or upon the vehicle, where the container would be immediately available to any passenger or occupant thereof.
