(A) It is prohibited and shall be unlawful for any person to keep or harbor any swine, pigs, hogs, chickens, or other such animals or fowl within the city limits.
(B) The keeping of livestock for non-commercial purposes shall be allowed if done by the property owner only and with required conditions:
(1) It shall be unlawful to keep or maintain any livestock within the city limits except on lots or parcels not less than five acres in size. For purposes of determining the lot/parcel size under this section, contiguous lots/parcels under a single ownership shall be included.
(2) This section shall apply only to owners of property within the city limits, who are currently residing upon the property on which the livestock is kept.
(3) It shall be unlawful for any person to keep or maintain any livestock within the city limits, unless such livestock be kept within an enclosed area meeting the following requirements:
(a) The enclosed area must be at least one and one-half acres in size per head of livestock kept within the area;
(b) The enclosed area must sit at least 30 feet from any neighboring property line;
(c) There shall be no residential dwelling, easement, or right-of-way located within any livestock enclosed area;
(d) Any enclosed area under this section shall be secured by fencing a minimum of five feet in height with an additional minimum of six inches of barb wire or other fencing, in good repair, and sufficient to prevent the livestock from leaving the owner's property;
(e) Any enclosed area under this section shall not be located within 150 feet from any creek, stream, lake, or other body of water;
(f) Any enclosed area under this section shall contain a covered structure for the housing of the livestock kept within the enclosed area. Any such structure shall be required to meet the necessary setback requirements per the applicable zoning regulations for the property; and
(g) Any enclosed area and/or covered structure used for the keeping of livestock under this section shall be kept in a clean and sanitary condition, so as to protect the animal from intentional neglect. Any storing or stockpiling of manure and/or animal waste shall be considered a violation of this section.
(4) Any livestock found within the city limits being kept in violation of this section shall be deemed a threat to the public safety and may be removed or impounded at the expense of the owner.
(5) No livestock shall be kept within the city limits for any commercial purpose including but not limited to: riding stables, the boarding of livestock which are not owned by the property owner, breeding of livestock for a commercial purpose.
