(A) Any cesspool, septic or sewerage tank or privy which shall be constructed or maintained on any property in violation of the provisions of this subchapter shall be and is hereby declared to be a public nuisance and shall, upon seven days’ notice to the owner of said premises, be abated.
(B) Should the owner fail or refuse to abate said nuisance within seven days after receiving written notice thereof from the village, then the village shall abate said nuisance and the owner of the premises shall be liable to the said village for the costs and expenses of abating same.
