(A) Any person who shall make available for the use of the public any pinball machine, or coin- operated game or device, on premises owned or occupied by him or her shall obtain a license from the town permitting him or her to do so. The license shall provide that the holder thereof is entitled to make available to the use of the public a specified number of machines or devices, and shall be valid for a period of one year from date of issue. The Clerk-Treasurer of the town shall issue licenses as provided in this section upon application therefor, accompanied by payment of a fee of $10 for each machine held on the premises of the applicant.
(B) No license issued as stated above shall be transferable from the premises for which it was originally issued, but any license of this type shall be transferable from an occupant of any premises to the succeeding occupant thereof.
(C) It shall be unlawful for any person to make available for the use of the public any pinball machine, or coin-operated game or device, without first obtaining a license as herein provided; and each machine so maintained and each day’s violation shall constitute a separate offense. It shall be deemed a violation of this provision to maintain pinball machines, or coin-operated games or devices, in excess of the number specified on an otherwise valid license issued pursuant to this section.
