§ 94.35 APPLICATION PROCEDURE.
   (A)   Upon presentation by any property owner of a written application therefor, the Town Council will consider at its next regularly scheduled meeting, when the action has been properly placed on the agenda of the meeting, the vacation of any street, alley, or other public way. Any such application may be signed by so many adjoining property owners as may wish to join therein. Whenever an adjoining property owner does not join in the application, the applicant shall present a written statement signed by that property owner attesting to his or her awareness of the pendency of the application, or a certified mail receipt showing his or her receipt of a notice of the pendency. Any application shall indicate with reasonable exactness, the limits of the street, alley, or other public way, and shall be available for public inspection at the Town Hall during normal business hours. Prior to the enactment of any ordinance of vacation, it shall be the duty of the applicant to furnish the Town Council with sufficient copies of an adequate legal description of the street, alley, or other public way to be vacated. All survey costs and other costs attendant to the production of description shall be borne by the applicant.
   (B)   An application fee in the amount of $25 shall accompany each application.
