§ 93.55 VIOLATIONS; REMEDIES NOT EXCLUSIVE.
   Whoever creates or maintains any nuisance defined in this subchapter, or by any other law, or ordinance of this town, and who fails or refuses to abate the nuisance when so ordered, shall be subject to penalties as provided in § 10.99 of this code. A separate offense shall be deemed committed upon each day during or on which the violation occurs or continues beyond the date fixed by the Town Council for abatement of that nuisance. The action against any person to enforce a penalty by the town shall constitute a separate and additional legal remedy and the fact that any proceedings by way of an injunction, or for the abatement of any such nuisance, or any other remedy, has been or may be instituted by the town and be pending or concluded, shall not affect this section or be considered in any way as a defense to the action for the penalty herein prescribed.
