§ 92.36 VIOLATIONS.
   (A)   A town official, officer, or designee may issue any person in violation of this subchapter a notice of ordinance violation. The penalty established in division (B) below shall be paid to the Town of Atlanta's Clerk-Treasurer within 14 days of the notice of ordinance violation. In the event that such payment is not made within 14 days, the town may file a proceeding in Hamilton County, Indiana court of competent jurisdiction to collect the applicable penalty.
   (B)   Persons who violate any provision of this subchapter shall be subject to one verbal warning for the first violation; a fine of $100 for the second violation; and a fine of $500 and revocation of the chicken flock permit for the third violation. These fines shall be permitted in addition to any and all other applicable fines for the violations of other town ordinances or state and federal laws.
   (C)   Any person whose permit has been revoked pursuant to this section shall be permanently barred from applying for or obtaining a permit to harbor chicken. A person who harbors chickens after the revocation of the person's permit shall be subject to a fine of $500 per day for each day the violation continues. Each day in violation shall constitute a new and separate offense.
   (D)   Upon revocation of the permit by Atlanta Town Council under this subchapter, the person whose permit was revoked shall remove all coops, runs, and storage equipment related to the harboring of chickens from their property at their expense within seven days of receiving notice of said revocation. If the person fails to remove said structures and equipment, the Town of Atlanta reserves the right to perform the removal at the expense of the person whose permit was revoked subject to a lien on that person's real property.
