4-2-2: ADDITIONS, INSERTIONS AND CHANGES:
The following sections are hereby revised as follows:
These regulations shall be known as the building code of the city.
Section 103.1: Continuation Of Existing Use: The legal use and occupancy of any structure existing on the date of adoption of this code, or for which it has been heretofore approved, shall be permitted to continue for which it has been heretofore approved, shall be permitted to continue without change, except as is specifically covered in this code, the existing structures or as is deemed necessary by the code official for the general safety and welfare of the occupants and the public.
Section 103.4: Rehabilitation: Buildings existing prior to November 1, 1987, in which there is work involving repairs, alterations, additions or changes of use, shall be made to conform to the code by applying the requirements of article 32 or the provisions of articles 2 through 31.
Section 109.2: Appointment: The code official (a.k.a. building and safety official) shall be appointed by the chief appointing authority of the jurisdiction by and with the consent of the city council.
Section 111.6.1: Private Sewage Disposal System: The site plan shall indicate the location of a private sewage disposal system when a public sewer is not available.
Section 117.4: Violations Penalties: Any person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the code official, or of a permit or certificate issued under the provisions of this code, shall be guilty of a misdemeanor, punishable by a fine of not less than fifty dollars ($50.00) or more than five hundred dollars ($500.00). Each day that a violation continues shall be deemed a separate offense.
Section 188.2: Unlawful Continuance: Any person who shall continue any work in or about the structure after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe conditions, shall be liable to a fine of not less than fifty dollars ($50.00), nor more than five thousand dollars ($5,000.00).
Section 124.1: Application For Appeal: Any owner of a building or structure or duly authorized representative thereof who has been served with unsafe order and notice to make such structure safe, secure or habitable to take down and remove such structure, or who has received a decision of the code official refusing to grant a modification to the provisions of this code covering the manner of construction or materials to be used in the erection, alteration, repair of the building or structure shall have the right to appeal to the board of appeals if that person deems such order or decision to be unnecessary, improper or unreasonable. An application to appeal shall be in writing and shall be based on a claim that the true intent of the code or the rules legally adopted thereunder have been incorrectly interpreted, the code provisions do not fully apply or an equivalent form of construction can be used.
Section 200.3: Terms Defined In Other Codes: Where terms are not defined in this article and are defined in other city codes, they shall have the meanings ascribed to them as in those codes.
Section 306.2.1: Exempt Amounts Of Hazardous Materials, Liquids And Chemicals: Note C shall be amended to read: Tank storage up to six hundred sixty (660) gallons for the fuel burning equipment.
Section 401.4.2: Ducts: Nonmetallic ducts as permitted by the mechanical code of the city, if any.
Section 401.4.3: Piping: Combustible piping materials as permitted by the city mechanical code, if any, and the city plumbing code.
Section 600.4: Heating And Venting: The requirements herein prescribed for the installation of heating and venting appliances and equipment shall be construed as supplemental to the provisions of articles 7 and 25, and the city mechanical code, if any.
Section 600.5: Equipment Rooms: Heating and ventilating, equipment in occupancies involving fire hazards from flammable vapors, dust, combustible fibers or other highly combustible substances shall be installed and protected against fire and explosion hazards in accordance with the city mechanical code, if any. Rooms containing such equipment shall be segregated by construction of not less than two (2) hour fire resistance rating except as otherwise required for specific uses, without openings in the enclosure walls and with means of direct ingress and egress from the exterior, or such equipment shall be located in accessory structures segregated from the main building.
Section 600.8: Inspections: All buildings and structures involving the use and handling of flammable or explosive materials and other hazardous uses and occupancies, and buildings of use groups A and E shall be inspected in accordance with the city fire prevention code, if any.
Section 600.8.1: Coordination Of Inspections: The code official, fire prevention code official, health officials and other administrative agencies of the jurisdiction to whom the authority is delegated to inspect buildings and structures in respect to the maintenance of safe conditions of use and occupancy shall immediately notify the respective official of any violation of the provisions of this code or the city fire prevention code, if any, and health rules and regulations.
Section 602.2: Maintenance And Inspection: All fire protection systems shall be maintained in an operative condition at all times and shall be periodically inspected and tested in accordance with the city fire prevention code, if any.
Section 603.1.7: Ventilation, General: Ventilation systems shall comply with the city mechanical code, if any, except as otherwise provided herein. Ventilation including recirculated air shall be provided throughout the fab area at the rate of not less than 1 cfm per square foot (5074 cm3/s/m2) of floor area.
Section 604.1: General: The provisions of this section shall apply to air supported, air inflated, membrane covered frame structures, collectively known as membrane structures, erected for a period of ninety (90) days or longer. Those erected for a shorter period of time shall comply with applicable provisions of the city fire prevention code, if any, and section 626.0. Membrane structures covering water storage facilities, water clarifies, water treatment plants, sewage treatment plants, and similar facilities not used for human occupancy are required to meet only the requirements of section 626.0 and section 604.5 of this section.
Section 607.1: General: The provisions of this section shall apply to all buildings in which materials producing flammable dusts and particles which are readily ignitable and subject to explosion hazards are stored or handled, including, among others, grain bleachers and elevators, malt houses, flour, feed or starch mills, wood flour manufacturing and manufacture and storage of pulverized aluminum, coal, cocoa, magnesium, spices, sugar or similar material producing dust. The provisions of NFiPA 61A, 61B, 61C, 61D, 65, 85F, 651, 653, 654, 655, and 665 and the city fire prevention code, if any, except as herein specifically required, shall be deemed to conform to the requirements of this code.
Section 607.3: Basements: Basements which are not classified as open parking structures in accordance with section 607.1 but are used for parking vehicles shall be sprinklered in accordance with the provisions of section 1002.0 and shall be ventilated in accordance with the city mechanical code, if any.
Section 609.2.4: Floor Construction And Drainage: Floors of public garages and airplane hangars shall be graded to drain through oil separators or traps to avoid accumulation of explosive vapors in building drains or sewers as provided in the city plumbing code. The floor finish shall be of concrete or other approved nonabsorbent, noncombustible material.
Section 609.3: Fuel Dispensing Areas: Fuel dispensing areas shall be located on the level nearest grade. Public garages with fuel dispensing areas shall be completely separated from any other use, both horizontally and vertically, by fire separation walls and floor/ceiling assemblies having a minimum fire resistance rating of two (2) hours. The floors of the fuel dispensing areas shall be graded to a floor drainage system such that any fuel spill or leak is contained within the area. The drainage system shall conform to the requirements of the city plumbing code. The fuel dispensing area shall be protected with an approved automatic fire suppression system in accordance with section 1002.10.
Section 609.3: Fuel Dispensing Systems: All fuel dispensing and storage systems shall conform to the requirements of the city mechanical code, if any.
Section 609.4: Ventilation: All public garages shall be ventilated in accordance with the city mechanical code, if any. Fuel dispensing areas shall be mechanically ventilated.
Section 617.3: Explosion Relief: Means for explosion relief shall be provided as specified in section 618.0, or such spaces shall be equipped with the equivalent mechanical ventilation complying with the city mechanical code, if any.
Section 619.1: Main Storage: Main storage systems of flammable and combustible liquids shall be constructed and installed in accordance with NFiPA 30 and the city fire prevention code, if any.
Section 619.4: Dry Cleaning Plants: The constructions and installation of dry cleaning plants shall be in accordance with the requirements of this code, the city mechanical code, if any, the plumbing code and NFiPA 32.
Section 620.1: General: The design and construction of propane, butane, propylene, butylene and other liquefied petroleum gas distribution facilities shall conform to the applicable provisions of this section. The storage and handling of liquefied petroleum gas systems shall conform to the city fire prevention code, if any. The design and installation of piping, equipment and systems which utilize liquefied petroleum gas shall be in accordance with the city mechanical code, if any. Liquefied petroleum gas facilities shall be ventilated in accordance with the city mechanical code, if any, and section 620.1.1.
Section 622.3: Spray Spaces: All spray spaces shall be ventilated with an exhaust system to prevent the accumulation of flammable mist or vapors in accordance with the city mechanical code, if any. When such spaces are not separately enclosed, noncombustible spray curtain shall be provided to restrict the spread of flammable vapors.
Section 622.3.1: Spray Booths: All spray booths shall be constructed of noncombustible materials and equipped with mechanical ventilating systems in accordance with the city mechanical code, if any.
Section 701.1: General: Plans for all buildings and structures other than buildings of use groups R-2 and I-1 which are designed for human occupancy shall designate the number of occupants to be accommodated in the various rooms and spaces, and when means of artificial lighting and ventilation are required, the application shall include sufficient details and descriptions of the mechanical system to be installed as herein required or as specified in the city mechanical code, if any.
Section 706.3: Contaminants Exhausted: Contaminants in the breathing atmosphere shall be exhausted to the outdoor air in accordance with the city mechanical code, if any.
Section 707.1: General: Mechanical ventilation shall conform to the requirements of the city mechanical code, if any.
Section 709.3: Alternative Mechanical Ventilation: Enclosed attic, rafter and crawl spaces which are not ventilated as herein required shall be equipped with a mechanical ventilation system conforming to the requirements of the city mechanical code, if any.
Section 710.7: Court Drainage: The bottom of every court shall be properly graded and drained to a public sewer or other approved disposal system complying with the city plumbing code; and shall be paved with concrete or other nonabsorbent material when required by the code official.
Section 918.2: Where Required: Fire dampers shall be provided at locations where air distribution systems penetrate assemblies required to have a fire resistance rating.
   Exceptions: Fire dampers are not required:
      1.   Where proper fire tests have shown that fire dampers are not necessary to maintain the integrity of the fire resistance rated assembly.
   2.   Where an exhaust duct penetrates a fire resistance rated shaft wall and the subduct extends not less than twenty two inches (22") (559 mm) vertically upward.
   3.   At penetrations of tenant separation and corridor walls in buildings equipped throughout with an approved automatic fire suppression system.
   4.   Where the ducts are constructed of steel and are part of an engineered smoke removal system.
   5.   At penetrations of corridor walls when the ducts are constructed of steel and do not have openings which communicate the corridor with adjacent spaces or rooms.
   6.   At penetrations of a roof assembly when ducts are open to the atmosphere.
   7.   In hazardous exhaust systems as defined in the city mechanical code, if any.
   8.   Where ceiling dampers are installed in accordance with section 913.1.
Section 927.7.2: Emergency Discharge: A pipe or outlet shall be located in the bottom, or the tank shall be fitted with a quick opening valve, to enable the contents to be discharged in an emergency to a suitable drain complying with the city plumbing code.
Section 928.2: Exposed Installations: Such materials, when exposed as installed in rooms or spaces, including attics and crawl spaces of buildings of any type construction, shall have a flame spread rating of twenty five (25) or less and a smoke developed rating of four hundred fifty (450) or less when tested in accordance with ASTM E84. Plenum installations shall comply with the requirements of section 929.0 and the city mechanical code, if any.
Section 929.2.3: Ducts: Rigid or flexible ducts and connectors shall conform to the city mechanical code, if any.
Section 929.2.4: Duct Coverings: Duct coverings, linings, tape and connectors shall conform to the city mechanical code, if any.
Section 1002.20: Installation Requirements: The installation methods, repair, operation and maintenance of fire protection systems shall be in accordance with this code and the city fire prevention code, if any.
Section 1002.20: Kitchen Exhaust Systems: In commercial kitchen exhaust systems when such systems are required by the city mechanical code, if any.
Section 1002.21: Hazardous Exhaust Systems: In duct systems exhausting hazardous material in accordance with the city mechanical code, if any.
Section 1008.6: Range Hoods: In addition to the requirements of this section, section 1002.20 and the city mechanical code, if any, range hood CO2 systems shall bear the label of an approved agency. The system shall be installed in accordance with the manufacturer's installation instructions.
Section 1010.6: Range Hoods: In addition to the requirements of this section, section 1002.20 and the city mechanical code, if any, range hood dry chemical systems shall bear the label of an approved agency. The system shall be installed in accordance with the manufacturer's installation instructions. The dry chemical agent of the system shall be nontoxic.
Section 1012.7: Tests: All standpipe systems shall be flow tested and hydrostatically tested in accordance with the city fire prevention code, if any.
Section 1019.1.3: Inspections: All operating parts of the smoke control systems specified in sections 1019.5 and 1019.6 (including dampers) shall be tested by the owner every three months and a log of the tests shall be kept for examination by the fire department. At six month intervals, the system shall be inspected and operated in accordance with the city fire prevention code, if any.
Section 1224.5.3: Drainage Disposal: The floor base and foundation perimeter drain shall discharge by gravity or mechanical means into an approved drainage system complying with the city plumbing code.
Exception: Where a site is located in a well drained gravel or sand-gravel mixture soils, a dedicated drainage system is not required.
Section 1303.6: Tests Of Service Equipment And Devices: Tests of service equipment and accessories shall include proscenium curtain and stage ventilation in accordance with sections 615.2.6 and 615.2.8; structural load tests in accordance with section 1302.0; flues, chimneys and boilers in accordance with the city mechanical code, if any; electrical installations in accordance with section 2070.0; escalators, elevator interlocks and safety devices in accordance with section 2602.0; refrigerating equipment and other mechanical and plumbing systems and devices as required by the city mechanical code, if any, and city plumbing code, and all other service tests required by the approved rules.
