3-2-1: RECEPTACLE REQUIREMENTS:
   A.   Receptacles Required: In all cases, it shall be the ultimate responsibility of the owner, titleholder, or contract for deed buyer to provide the proper garbage, refuse and rubbish receptacles for the premises. (Ord. 08-2001, 9-10-2001; amd. 2017 Code)
   B.   Specifications:
      1.   Less Than Three Dwelling Units: The owner or occupant, lessee or contract for deed buyer of any single-family residence or multiple-dwelling residence with less than three (3) dwelling units shall provide, or cause to be provided, a receptacle or receptacles that are:
         a.   Clean and in good repair.
         b.   Galvanized metal or plastic with a close fitting metal or plastic cover.
         c.   Watertight.
         d.   A capacity of not less than five (5) nor more than thirty five (35) gallons.
         e.   With suitable handles for carrying.
         f.   Sufficient to contain the accumulation of waste material for a period of at least seven (7) days. (Ord. 08-2001, 9-10-2001)
      2.   All Other Receptacles: The owner, lessee, titleholder of record or contract for deed buyer of any multiple-dwelling residence with three (3) or more dwelling units or such person who uses a building premises for commercial business shall provide and maintain clean and in good repair receptacles commonly known as dumpsters. The dumpsters shall include lids which shall be kept closed at all times except when garbage is being deposited in the dumpster or when the dumpster is being emptied. Dumpster capacity shall be sufficient to contain the accumulation of waste material for a period of at least seven (7) days. Such person as herein described may petition the chair of the health and safety committee or the mayor of the city for an exemption from the requirements hereof. If the chair of the health and safety committee or mayor decides that the receptacle facilities are adequate and do not present a hazard to the public health and safety, a permit to exempt the person's premises may be issued. This permit may be revoked if, at any time, the receptacle facilities become inadequate or present a hazard to the public health and safety. (Ord. 08-2001, 9-10-2001; amd. 2017 Code)
   C.   Placement: All receptacles for the collection of garbage, refuse and rubbish shall be placed on the owner's premises in an accessible place at ground level. No receptacle shall be placed on public property or right of way so as to impede or interfere with pedestrian or motor vehicle traffic. (Ord. 08-2001, 9-10-2001)
