(a) No motor vehicle, including a truck, passenger car, motorcycle, tractor, motor bike, trailer, house trailer or mobile home, shall be driven, operated or parked in any area of the Municipality Public Park, also known as Miller’s Park, where it is not permitted therein by proper sign, notice, ordinance, or resolution of the Municipality; and a motor vehicle, including a truck, passenger car, motorcycle, tractor, motor bike, trailer, house trailer or mobile home may be driven, operated or parked in the Park only in those areas and places thereof as are designated for its use and or occupancy by sign, notice, ordinance, or resolution of the Municipality.
(b) No person or motor vehicle, including those forms of transportation previously designated in subsection (a) hereof shall enter, remain or be in the Park between the hours of 11:00 p.m. and 6:00 a.m. except during the July 4th celebration annually held in the Park by the Ashville Community Club. (c) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
