(a) Hours; Exceptions.
(1) No minor shall be upon the streets, highways, any public place or place of amusement between the hours of 12:30 a.m. and 5:00 a.m. unless accompanied by a parent.
(2) The provisions of this section shall not apply to a minor accompanied by a parent, guardian or other adult.
(3) The provisions of this section shall not apply to a minor pursuing a legitimate business at the direction of a parent, guardian or other adult.
(4) The provisions of this section shall not apply to a minor having an otherwise legal excuse for being upon the streets, highways, any public place or places of amusement during the prohibited hours.
(b) Definitions.
(1) “Minor” means any person up to eighteen years of age.
(2) “Other adult” means any person eighteen years of age or over in loco parentis to the minor.
(3) “Legitimate business” means participation in or attendance of bona fide religious, public or civic groups which are supervised by an adult. This definition includes such groups as YMCA, YWCA, Boy Scouts of America, schools and churches, but this list is not exclusive. This definition also includes the lawful employment of such minor.
(c) Enforcement.
(1) Any person under the age of eighteen years who violates the provision of this curfew, shall be apprehended and charged as being an unruly child and taken before the Juvenile Court in Ashland County, Ohio, as provided in Ohio R.C. Chapter 2151.

(2) Any minor so apprehended may be detained, overnight, in accordance with the provisions of Ohio R.C. Chapter 2151, in the juvenile detention facility of the County Juvenile Detention Center operated by the Juvenile Court.

(3) Every reasonable effort shall be made to contact a parent, guardian or other adult to whom any minor so apprehended shall be released in lieu of being detained overnight, as stated above.
