(a) A uniformed Law Enforcement Officer (LEO) with patrol car shall be provided for controlling traffic under the following conditions:
(1) When any substantial work is performed within a signalized intersection, defined as the area bounded by the rear crosswalk lines;
(2) When flagging within the intersection of two arterial roadways;
(3) When specified within an approved Maintenance of Traffic Plan or as directed by the City Engineer with approval from the Mayor, Director of Public Service and Safety.
(b) Law Enforcement Officers (LEO) shall be from the City of Ashland Police Department within corporation limits as authorized by the Police Chief. The Police Chief shall have the authority to waive this requirement and approve the use of an alternate LEO from another jurisdiction.
(c) The use of a LEO without a patrol car is permitted where specified within an approved Maintenance of Traffic Plan or as directed by the Police Chief.
(d) Where applicable, LEO's shall be contracted with the City of Ashland Police Department by the Contractor at the Contractor's expense. As such, the Contractor shall be responsible for the scheduling and placement of the LEO in conformance with the Ohio Manual of Uniform Traffic Control Devices (OMUTCD), latest edition.
(e) The City Engineer, with concurrence from the Police Chief and approval from the Mayor, Director of Public Service and Safety, shall have the authority to waive any or all of these requirements where applicable.
