(a) Whoever violates any provision of this Chapter or a permit or order issued pursuant to the provisions of this Chapter shall be subject to a civil penalty of up to one thousand dollars ($1000.00) for each offense. A separate offense shall be deemed to have been committed each period of twenty-four (24) hours such violation continues.
(b) Whoever violates any provision of this Chapter or who knowingly makes any false statements, representation or certification in any application, record, report, plan or other document filed or required to be maintained pursuant to this Chapter, or who falsifies, tampers with or knowingly renders inaccurate monitoring device or method required herein shall, upon conviction, be punished by the imposition of criminal penalties not exceeding $1,000.00 and/or six (6) months in jail.
