921.03 UNLAWFUL CONSTRUCTION.
   No privy vault, septic tank, cesspool or outside toilet shall be constructed in the City, except where it is necessary in construction work, to provide temporary accommodations for workmen or employees until connection to a sewer can be made. No existing privy vault, septic tank, cesspool or outside toilet shall be repaired, maintained or allowed to remain on any lot or land in the City, except where the residence building, business building or other principal building on such lot or land is, at the nearest point, more than 250 feet (76 m) from a public sewer, or, if nearer than 250 feet to a public sewer, upon the granting of special permission by City Council, provided that such facility meets all applicable requirements of the City, the City/County Health Department and the OEPA, and subject to such further conditions as council deems necessary and appropriate in each particular instance. City Council may grant special permission for construction of a temporary private system at the owner's expense, subject to securing the necessary permits and compliance with the requirements of the City, the City/County Health Department, and the OEPA.
