753.01 DEFINITION.
   As used in this chapter, "itinerant vendor" or "transient merchant" mean any person, either a principal or agent or both, who engages in or operates or conducts in any one locality, or in traveling from place to place, a temporary or transient business of selling goods, wares and merchandise, whether or not such goods, wares and merchandise or any part thereof are imported into the City from another town or city other than the place of intended sale, or are purchased or otherwise acquired within the city where the sale of such goods, wares and merchandise are intended to be sold with the intention of continuing in such business in any one place for a period of not more than 120 days, and who for the purpose of carrying on such business, hires, leases or occupies, either in whole or in part, a room, building or other structure, or any other place, for the exhibition and sale of such goods, wares and merchandise at retail, public auction or otherwise.
