§ 158.06 SPECIAL USE PERMIT REQUIRED TO ERECT TOWER.
   It shall be unlawful for any person, corporation, partnership or other entity to erect a tower or replace an existing tower without first obtaining a special use tower permit application (referred to as “tower application”) from the Ashe County Planning Department, and being duly approved by the Ashe County Board of Adjustment. Upon approval of the permit by the Board of Adjustment, the applicant must also obtain necessary permits from the Ashe County Building and Inspections Department before construction begins. Approvals must be provided in writing; may be provided in print or electronic form; if electronic form is utilized, must be protected against further editing pursuant to G.S. §160D-403(a). Approvals must also run with the land (see G.S. §160D-104).
