§ 163.53 QUORUM AND VOTE REQUIRED.
   (A)   Quorum. A quorum of the Board of Adjustment, necessary to conduct any business hereunder, shall consist of 4/5 of the total membership of the Board of Adjustment (at least four of five members must be present to conduct any business).
   (B)   Voting on other than variances. The concurring vote of a simple majority of the total membership of the Board of Adjustment shall be necessary in order to:
      (1)   Reverse any order, requirement, decision or determination of the Planning Board; or
      (2)   Decide in favor of the applicant any matter upon which it is required to pass by this chapter, other than a variance.
   (C)   Voting on variances. The concurring vote of 4/5 of the total membership of the Board of Commissioners shall be necessary in order to approve an application for a variance.
