§ 163.51 POWERS OF BOARD OF COMMISSIONERS.
   The Board of Adjustment shall have the following powers:
   (A)   Appeals. To hear, decide and review appeals from any order, requirement, decision, or determination made by the Planning Board in the performance of its duties hereunder, including appeals from the Planning Board's failure to notify an applicant and the property owner as to the Planning Board's decision on an application within 30 days under § 163.36(C).
   (B)   Variances. To hear and decide applications for variances from the requirements of this chapter in accordance with § 163.54. Nothing in this division shall be construed to broaden the power of the Board of Adjustment to permit a use by variance beyond that power given in § 163.54.
