§ 70.60 PROHIBITION OF THE SOLICITATION OF EMPLOYMENT, BUSINESS, OR CONTRIBUTIONS UPON HIGHWAYS OR STREETS.
   (A)   Except as provided in division (B) below, no person shall stand on any street, highway, or right-of-way excluding sidewalks while soliciting, or attempting to solicit, any employment, business, or contributions from the driver or occupants of any vehicle.
   (B)   Not withstanding the prohibition found in division (A) above, a person may engage in the distribution of newspapers on the non-traveled portion of any street or highway so long as the distribution activities do not impede the normal movement of traffic on the street or highway. It shall be unlawful for any person to impede the normal movement of traffic on the street or highway.
   (C)   The provisions of this section shall not apply to licensees, employees, or contractors of the North Carolina Department of Transportation or the City of Asheboro that are engaged in construction, maintenance, or in making traffic or engineering surveys.
   (D)   If any person shall violate this section, he or she shall be guilty of a Class 3 misdemeanor and shall be fined not more than $500 in accordance with G.S. § 14-4.
   (E)   Severability is intended throughout and within the provisions of this section. If any sentence, clause, or phrase of this section is held to be invalid or unconstitutional by a court of competent jurisdiction, then such judgment shall in no way affect or impair the validity of the remaining portions of this section.
