§ 34.79 POLICE DEPARTMENT AUTHORITY REGARDING CRIMINAL HISTORY INFORMATION FOR ABC PERMIT APPLICANTS.
   (A)   The Asheboro Police Department is authorized to seek state access to SBI/DCI Criminal History Record Information in order to obtain criminal history information on all persons applying for ABC permits for establishments located within the corporate limits of the city.
   (B)   Prior to acting on the basis of criminal history record information obtained pursuant to the authorization found in division (A) above and submitting an objection to the North Carolina Alcoholic Beverage Control Commission on behalf of the city with regard to an application for ABC permit(s), the City Manager shall verify the existence of a record by obtaining either a certified public record or by submitting a fingerprint card of the individual to the Criminal Information and Identification Section of the North Carolina State Bureau of Investigation for verification that the criminal history record information belongs to the individual to which the City Manager is objecting.
