If, after final inspection, approval and acceptance by the infrastructure director, any improvements are found to be defective due to construction or material failure, the subdivider/developer and/or installation contractor shall promptly, without cost to the city and in accordance with the infrastructure director, remove the defective improvements from the site and replace them as to the terms and instructions of the infrastructure director. Failure to correct the defective improvements within three (3) months of the infrastructure director's written instructions may result in the correction, removal, and replacement of the defective improvements by the city. All direct and indirect costs to correct, remove, and replace defective improvements, including any additional professional services, shall be paid by the subdivider/developer.
