(A) The penalty for any violation of an ordinance shall be as designated in Appendix A: Schedule of Violations and Penalties. All fines must be paid in person at the office of the Clerk-Treasurer or deposited or postmarked within 72 hours of three town working days of the violation notice if the reduced civil money penalty set forth in Appendix A is to apply. In any event, the civil penalty must be paid within 15 days of the violation notice. Nothing herein, however, shall be taken to prevent the Town Council from pursuing its remedies for abatement of nuisances as set forth in Chapter 91 Nuisances, when the Town Council deems appropriate, or from pursuing such other legal remedies as the Town Council may have.
(B) All second, third or more offenses in Appendix A are determined based on a calendar year from the date of the first offense. After the expiration of one year, a subsequent offense shall not be considered a second, third or greater offense.
