§ 10.02 DEFINITIONS.
   (A)   Unless clearly in conflict with definitions or other provisions of this code, or otherwise clearly inapplicable, definitions established for the state by statute or case shall apply to this code.

   (B)   Certain chapters of this code contain other definitions applicable particularly to such chapters. In case of any conflict between the definitions provided in this chapter and such other definitions, the other definitions shall prevail in the chapters where applicable.

   (C)   For the purpose of this code, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      CODE. The Town Code of Argos, Indiana.

      COUNCIL. The Town Council.

      COUNTY. The County of Marshall, State of Indiana.

      MONTH. A calendar month.

      OATH. An affirmation in all cases which, by law, an affirmation may be substituted for an oath, and in such cases the words “swear” shall be equivalent to the words “affirm” or “affirmed”.

      OWNER. When applied to a building or land shall include any person, group of persons, firm or firms, corporation or corporations, or any other legal entity having legal title to or sufficient proprietary interest, of the whole or part of such building or land.

      PERSON. Includes a corporation, firm, partnership, association, organization, trustee, or any other group acting as a unit, as well as a natural person.

      PROPERTY. Includes real and personal property. PERSONAL PROPERTY shall include every species of property except real property, and the words REAL PROPERTY shall include lands, tenements, and hereditaments.

      PUBLIC PLACE. Any street or highway, sidewalk, park, cemetery, school yard or open space adjacent thereto, and any lake, or stream, or any other place of public resort or accommodation.

      REASONABLE TIME. In all cases where any provision shall require any act to be done in “reasonable time” or “reasonable notice” to be given to any person, such reasonable time or notice shall be deemed to mean such time only as may be necessary in the prompt execution of such duty, or compliance with such notice.

      SIDEWALK. Any portion of the street between the curb line and the adjacent property line intended for the use of pedestrians, excluding parkways.

      SIGNATURE or SUBSCRIPTION. Includes a mark when a person cannot write.

      STATE. The State of Indiana.

      STREET. Includes streets, avenues, boulevards, roads, alleys, viaducts, and all other public highways in the town.

      TENANT. The words TENANT or “occupant” applied to a building or land shall include any person holding a written or oral lease of, or who occupies the whole or a part of such building or land, either alone or with others.

      TOWN. The Town of Argos, Marshall County, Indiana. “City”, “municipal corporation”, or “municipality” shall also mean the Town of Argos, Marshall County, Indiana.

      VEHICLE. Any device in, upon, or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power.
