§ 110.10 FRANCHISE TERMS.
   (A)   The franchise granted a grantee herein shall terminate 15 years from date of such grant; provided, however, that the franchise may be renewed for successive ten-year terms if the town shall determine to do so, after a public hearing as provided herein, that such renewal would be in the best interests of the town and its residents.
   (B)   It shall be the grantee’s obligation to apply for renewal of said franchise. Failure to so apply shall result in an automatic termination of the franchise.
   (C)   Not less than 45 days prior to the termination date of any term, the grantee shall give written notice to the town of such termination date, which written notice shall request a date, time, and place for public hearing on the renewal of the franchise desired by the grantee.
      (1)   Notice of the date, time, and place of said hearing and the purposes thereof shall also be published in a newspaper of general circulation in the town not less than once per week for two successive weeks; the last publication date being not less than ten days prior to the date of the hearing.
      (2)   The grantee as well as all members of the public interested in the renewal of the franchise or the modification of its terms shall be heard, and the town shall thereupon have the right to renew or not renew the franchise or to modify the terms thereof.
      (3)   The Town Council shall conduct such hearing and make the final determination regarding the renewal non-renewal of the franchise.
