§ 130.03 UNREASONABLE NOISE.
   (A)   No person shall make, cause or permit to be made or caused any unnecessary, excessive or offensive noise, which injures or otherwise endangers the comfort, repose, health, peace or safety of other persons with the limits of the village.
   (B)   For the purposes of this section, the following shall be presumed to be unnecessary, excessive or offensive noise and in violation of the provisions of division (A) above.
      (1)   No person operating or occupying a motor vehicle on a street, highway, alley park, parking lot or driveway shall operate or permit the operation of any sound amplification system from within the vehicle so that the sound is plainly audible at a distance of 50 or more feet from the vehicle.
      (2)   The operation, playing or permitting the operation or playing of any electronic device or musical instrument which produces, reproduces or amplifies sound so as to be audible and disturbing to surrounding properties, particularly between the hours of 11:00 p.m. to 7:00 a.m.
   (C)   Noises resulting from sporting and recreational events authorized by the village or school and other activities, which have the approval of the village.
   (D)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      AUDIBLE. Any sound that can be heard by a person using his or her normal faculties.
      MOTOR VEHICLE. Includes but is not limited to automobiles, recreational vehicles, trucks, with or without trailers, motorcycles, motorized bicycles and watercraft.
      PERSON. Any person, person’s firm, association, partnership, venture, corporation or any entity, public or private.
      PLAINLY AUDIBLE. Any sound produced by a sound amplification system, which can be heard at a distance of 50 feet or more. Measurement standards shall be by the auditory senses, based upon the direct line of sight. Words or phrases need not be discernible and base reverberations are included.
      PROPERTIES.  An imaginary line along the ground surface, and its vertical extension, which separates the real property owned or rented by one person from that owned by another.
      SOUND AMPLIFICATION SYSTEM. Any radio, tape player, compact disc player, loudspeaker or other device used for the playing or amplification of the human voice or other sound.
   (E)   Whoever violates this section shall be deemed guilty of a minor misdemeanor, and, upon conviction thereof, be fined not more than $100.
