Whoever violates any provision of this chapter is guilty of a misdemeanor of the third degree for each offense. Each day such violation continues shall constitute a separate and distinct offense. Where the act charged to be a violation or the act that is causation of the violation is committed, in whole or in part, by a person acting as an employee, representative, agent or officer of the owner or operator of the activity, the operation or maintenance of which is the causation of the violation, then and in that event, the employee, representative, agent or officer, as well as the owner or operator, shall be held to have violated this chapter.
