§ 91.01 OHIO FIRE CODE ADOPTED BY REFERENCE.
   (A)   The Ohio Fire Code, as presently promulgated, is adopted by reference. The code is hereby incorporated by reference into this chapter pursuant to R.C. § 731.231.
   (B)   The purpose of this code is to prescribe minimum requirements regarding storage and use of materials so as to prevent the risk of fire and explosions.
   (C)   A complete copy of the code is on file with the Village Clerk for inspection by the public and a complete copy of such is also on file in the law library of the county. The Village Clerk has copies of the code available for distribution to the public at cost.
   (D)   The code is hereby amended to include the following provisions.
      (1)   Section FM-2804.10 Restriction on the storage of flammable and combustible liquids in residential areas. No underground storage tanks for flammable and combustible liquids, excepting those which are used for the heating of a building or residence, and otherwise comply with this Fire Code, shall be permitted within any district which is zoned R-1, R-2 or R-3. This section shall not apply to any tank which has been installed prior to the effective date of this chapter.
      (2)   Section FM-2803.5 Above ground tanks prohibited in residential areas. No above ground flammable and combustible liquids storage tanks that exceed five gallons shall be permitted within an district which is zoned R-1, R-2 and R-3 within the village.
   (E)   No person shall knowingly violate any provision of the state’s Fire Code or any order made pursuant to it.

   (F)   Except as a violation of R.C. § 2923.17, regarding the felonies of unlawful possession of a dangerous ordnance and illegal manufacture or processing of explosives, which violation involves subject matter covered by the state’s Fire Code, whoever violates division (E) of this section is guilty of a misdemeanor of the first degree.
