§ 72.102 PLACING INJURIOUS MATERIAL ON HIGHWAY OR DEPOSITING LITTER FROM MOTOR VEHICLE.
   (A)   (1)   No person shall place or knowingly drop upon any part of a highway, lane, road, street or alley any litter which may damage or injure any person, vehicle or animal traveling along or upon the highway, except the substances that may be placed upon the roadway by proper authority for the repair or construction thereof.

      (2)   Any person who drops or permits to be dropped or thrown upon any highway any destructive or injurious material shall immediately remove the same.
      (3)   Any person authorized to remove a wrecked or damaged vehicle from a highway shall remove any glass or other injurious substance dropped upon the highway from the vehicle.
      (4)   No person shall place any obstruction in or upon a highway without proper authority.
   (B)   No person, with intent to cause physical harm to a person or a vehicle, shall place or knowingly drop upon any part of a highway, lane, road, street or alley any tacks, bottles, wire, glass, nails or other articles which may damage or injure any person, vehicle or animal traveling along or upon the highway, except the substances that may be placed upon the roadway by proper authority for the repair or construction thereof.

   (C)   No operator or occupant of a motor vehicle shall, regardless of intent, throw, drop, discard or deposit litter from any motor vehicle in operation upon any street, road or highway, except into a litter receptacle in a manner that prevents its being carried away or deposited by the elements.
   (D)   No operator of a motor vehicle in operation upon any street, road or highway shall allow litter to be thrown, dropped, discarded or deposited from the motor vehicle, except into a litter receptacle in a manner that prevents its being carried away or deposited by the elements.

   (E)   As used in this section:
      GARBAGE. Any putrescible animal and vegetable material resulting from the handling, preparation, cooking and consumption of food.
      LITTER. Garbage, refuse and rubbish and all other waste material which, if thrown or deposited as herein prohibited, tends to create a danger to public health, safety and welfare.
      REFUSE. All putrescible and nonputrescible solid material (except body wastes), including, but not limited to, garbage, rubbish, ashes, street cleanings, dead animals, abandoned motor vehicles, used motor vehicle parts, tires, junk, building materials, solid market and industrial wastes, used chemical and oil waste and any other similar substances, man-made or otherwise, which no longer serves the functional use for which it was intended.
      RUBBISH. All nonputrescible solid material consisting of both combustible and noncombustible matter, including but not limited to, paper, wrappings, cigarettes, cardboard, tin and aluminum cans, yard clippings, snow removals, leaves, wood, branches, glass, concrete, dirt, gravel, stone, plaster, plasterboard, roofing material, nails, bedding, crockery and similar materials.
   (F)   Whoever violates division (A)(1), (2), (3) or (4) of this section is guilty of a misdemeanor of the third degree.
   (G)   Whoever violates division (B) of this section is guilty of a misdemeanor of the first degree.
   (H)   Whoever violates division (C) or (D) of this section is guilty of a minor misdemeanor.
