(A) Should any exceptional topographic or other physical conditions be present in any facet of a proposed major or minor subdivision, or site plan, and should the Planning Commission find that extraordinary and unnecessary hardship may result from the strict application of these Regulations or that the purposes of these Regulations may be served to a greater extent by an alternative proposal, the Commission may approve variances, exceptions, and/or a waiver of condition(s) provided that they will not be detrimental to the public health, safety or welfare of other properties.
(B) Such variances shall not have the effect of nullifying the intent and purpose of these Regulations, applicable land use plans, and zoning ordinances where they exist, per § 152.134 of the Village of Archbold Zoning Code.
