§ 152.170 DEFINITIONS.
   Where a proposed use or term is not specifically identified by this Code, the Zoning Inspector may find a use or term similar to another use or term as defined and apply the Code accordingly. Similarly, uses and activities that this Code specifically prohibits in the subject zone, and uses and activities that are similar to those that are prohibited, shall not be permitted.
   ACCESSORY DWELLING UNIT. A separate, complete housekeeping unit with a separate entrance, kitchen, sleeping area, and full bathroom facilities, which is an attached or detached extension to an existing single-family structure or place of business.
   ACCESSORY USE or STRUCTURE. A use or structure that is subordinate in size or purpose to the principal structure or use of the same lot or parcel of ground and serving a purpose customarily incidental to the use of the principal structure or use of land.
   ADULT BUSINESS ESTABLISHMENTS. Bookstores, bars, lounges, restaurants, theaters, or shops, which have more than 20% of their stock in trade, or fare, books, pictures, slides, films, media of electronic visual portrayal, or live entertainment, which are distinguished or characterized by their emphasis on matter or live conduct depicting, describing, exposing, or relating to sexual activities or anatomical areas.
   AGRICULTURE. Agriculture shall include farming, dairying, pasturage, agriculture, horticulture, viticulture, animal and poultry husbandry and the processing and sale of agriculture products from land under same ownership or leased.
   ALLEY. A public or private dedicated way intended for vehicular service to the rear or side of property served by a street.
   ALTERATION. Any change in the supporting members of a building or structure or any exterior siding or architectural features to an existing building for the purpose of beautifying and modernizing
   ANIMAL BOARDING. Any structure, land, or combination thereof used for the boarding or care of dogs, cats, pets, fowl, horses, or other domestic animals for profit,
   ANIMAL GROOMING. Any place or establishment where animals are bathed, clipped, or combed for the purpose of enhancing their aesthetic value or health and for a fee.
   APPURTENANCE. The visible, functional, or ornamental objects accessory to and part of a building.
   AUCTION YARD. A place where vehicles, operable or inoperable, are offered for sale to persons who bid on the vehicles in competition with each other.
   AUTOMOTIVE AND VEHICULAR REPAIR. General repair; engine rebuilding; rebuilding or reconditioning of motor vehicles; collision services such as body, frame or fender straightening and repair; overall painting; and vehicle rustproofing. This includes motorcycles and other small engine vehicles.
   AUTOMOTIVE SALES. The sale or rental of new or used motor vehicles or trailers.
   AWNING (CANOPY). A roofed structure constructed of fabric or other material supported by the building or by supports directly under the canopy placed so as to extend outward from the building providing a protective shield for doors, windows, and other openings.
   BED & BREAKFAST INN. A house, or portion thereof, where short-term lodging rooms and meals are provided. The operator of the inn shall live on the premises.
   BOARD. The Board of Zoning Appeals of Archbold, Ohio.
   BUFFER AREA. A landscaped area intended to separate and partially obstruct the view of two adjacent land uses or properties from one another.
   BUILD TO LINE. A line established a certain distance from the back of sidewalk at which the front of the building shall be built.
   BUILD TO ZONE. An area established a certain distance from the back of sidewalk to a minimum and maximum line within which (the zone) the front of the building shall be built.
   BUILDING. An enclosed structure having a roof and foundation for a wide variety of activities, such as storage living, entertaining, or manufacturing.
   BUILDING FRONTAGE. The line along the face of the building nearest the front line of the lot. This face includes porches whether enclosed or unenclosed but does not include steps.
   BUILDING, HEIGHT OF. The vertical distance between the finished grade and the highest point of the building proper, exclusive of any accessory roof construction such as a chimney, steeple, or antenna.
   BUILDING, PRINCIPAL. A building in which is conducted the main or principal use of the lot on which the building is situated.
   BUSINESS SERVICES. Any activity conducted for gain which renders services primarily to other commercial or industrial enterprises, or which services and repairs appliances and machines used in homes or businesses.
   CANOPY. See AWNING.
   CEMETERY. Land used or dedicated to the burial of the dead, including crematoriums, mausoleums, necessary sales, and maintenance facilities. Mortuaries shall be included when operated within the boundary of such cemetery.
   CHANGE OF USE. Any change to a zoning use category or change to the Use and Occupancy Classification pursuant to the Ohio Building Code
   CLUB. A building or portion thereof or premises owned or operated by a corporation, association, person, or persons for a social, educational, or recreational purpose, but not primarily for profit or to render a service which is customarily carried on as a business.
   COMMERCIAL ENTERTAINMENT FACILITIES. Any activity conducted for gain, which is generally related to the entertainment field, such as theaters, nightclubs, arcades, and similar entertainment activities.
   COMMERCIAL RECREATIONAL FACILITIES. Recreational facilities open to the public, established, and operated for a profit, such as commercial golf courses, golf driving ranges, swimming pools, ice skating rinks, riding stables, racetracks, carnivals, and similar commercial enterprises.
   COMMERCIAL USE. An occupation, employment, or enterprise that is carried on for profit by the owner, lessee, or licensee.
   COMMISSION. The Planning Commission of Archbold, Ohio.
   COMMUNITY GARDEN. A private or public facility for cultivation of fruits, flowers, vegetables, or ornamental plants by more than one person in a communal setting.
   COMMUNITY SERVICES. Noncommercial services provided for the benefit of the community and/or special populations including health, recreation, food distribution and other resources provided for the community.
   COMPREHENSIVE PLAN. The most current, adopted official plan of Council of a local that sets forth goals, policies, and guidelines intended to direct the present and future physical, social, and economic development within the municipality.
   CONDITIONAL USE. A use, which is subject to approval by the Planning Commission. A conditional use may be granted by the Planning Commission only when there is a specified provision allowing for it in this code. A conditional use is not a use permitted by right and is not considered to be a nonconforming use.
   CONDOMINIUM ASSOCIATION. The community association, which administers and maintains the common property and common elements of a condominium.
   CONDOMINIUMS. A building, or group of buildings, in which units are owned individually, and the structure, common areas and facilities are owned by all the owners on a proportional, undivided basis. Real estate is not a condominium unless the undivided interests in the common elements are vested in the unit owners. Both residential condominiums and commercial condominiums exist.
   CONSTRUCTION SUPPLIES, SALES AND STORAGE. Retail and wholesale lumber yards and incidental millwork, storage facilities for building materials such as sand, gravel, stone, lumber, and sale or rental of contractor's equipment.
   COTTAGE FOOD PRODUCTION OPERATOR. A person who, in the person's home, produces food items that are not potentially hazardous foods, including bakery products, jams, jellies, candy, fruit butter, and similar products specified in rules of the State of Ohio.
   COUNCIL. The Council of Archbold, Ohio.
   CRAFT MANUFACTURING. Craftsman studios and limited production handmade goods; uses providing instruction and/or retail sales related to painting, sculpting, photography, picture framing, knitting, sewing, literature, theater, music, specialty foods or catering, or similar uses.
   CRYPTOCURRENCY MINING. The operation of specialized computer equipment for the purpose of mining one or more blockchain-based cryptocurrencies, such as Bitcoin. This activity typically involves the solving of algorithms as part of the development and maintenance of a blockchain which is a type of distributed ledger maintained on a peer-to-peer network. Typical physical characteristics of cryptocurrency mining include specialized computer hardware for mining operations as well as equipment to cool the hardware and operating space. For the purposes of the associated regulations, cryptocurrency mining does not include the exchange of cryptocurrency or any other type of virtual currency.
   CULTURAL CENTER. Services to the public, such as but not limited to museums, art galleries, and libraries by a public or private, nonprofit facility.
   DAY CARE CENTER, ADULT. A state licensed facility to provide necessary care and supervision to persons 18 years of age or older on less than a 24-hour basis. Adult day care centers include the various types of adult day services as defined under state law and periodically amended, which includes "adult day care facilities, adult social day care facilities, and adult day health care facilities."
   DAY CARE CENTER, CHILD. A state licensed facility, other than a family day care home, providing non-medical care and supervision to children less than 18 years of age on less than a 24-hour basis. Child day care centers shall include "day care centers" as defined under state law and periodically amended, which includes infant centers, preschools, and extended day care facilities.
   DISH ANTENNA. A device incorporating a reflective surface that is solid, open mesh, or bar configured and is in the shape of a shallow dish, cone, horn, or cornucopia. Such device shall be used to transmit and/or receive radio or electromagnetic waves between terrestrially and/or orbitally based uses. This definition is meant to include but not be limited to what are commonly referred to as satellite earth stations, TVROs (television reception only satellite dish antennas), and satellite microwave antennas.
   DISTRICTS, ZONING DISTRICTS. Administrative tracts designating the uses to which land can legally be utilized. Boundaries of the districts are shown on the "district map" which is part of this chapter.
   DRIVE-THROUGH SERVICE. Any retail or commercial service providing services to patrons seated in an automobile or other vehicle. Said service may be in conjunction with or irrespective of other forms of service such as walk in or delivery.
   DWELLING. Any building or portion thereof, which is designated for or used for residential purposes.
      MULTI-FAMILY. A building used or designed as a residence for four or more families living independently of each other and doing their own cooking therein, including apartment houses, garden apartments and row houses.
      SINGLE-FAMILY. Detached, individual dwelling units, which accommodate one family related by blood, adoption, marriage, or common law partnership: or up to five unrelated individuals living as one housekeeping unit. The type of construction of such units shall conform to the Ohio Residential Code.
      SINGLE-FAMILY, ATTACHED. A building on its own separate lot containing one dwelling unit that occupies space from the ground to the roof and is attached to one or more other dwelling units by at least one common wall. This includes townhomes and villas.
      TWO- AND THREE-FAMILY. A building containing no more than three units, each of which has primary access to the outside and which are attached to each other by party walls on a single lot. The type of construction of such units shall conform to the Ohio Residential Code.
   EASEMENT. The right of a person, government agency, or public utility company to use public or private land owned by another for a specific purpose.
   EMERGENCY SERVICES. Buildings and facilities which provide public safety and emergency services, such as, but not limited to, fire stations, police stations, and emergency medical and ambulance service.
   ESSENTIAL SERVICES. Public or private utilities or municipal or other governmental agencies of underground gas, electrical or water transmission or distribution systems, collection, communication, supply or disposal systems, including poles, wires, mains, drains, sewers, pipes, traffic signals, hydrants and other similar equipment and accessories reasonable in connection therewith for the furnishing of adequate service by such public utility or municipal department or commission for the public health or general welfare, but not including buildings other than such buildings as are primarily enclosures or shelters of the above essential service equipment.
   FAMILY. One or more persons occupying a dwelling, living as a single housekeeping unit, and doing their own cooking on the premises as distinguished from a group occupying a boarding house or hotel, as herein defined.
   FEE SIMPLE. A form of land ownership that includes all property rights to land and structures.
   FENCE. An artificially constructed barrier of wood, masonry, stone, wire, metal, or other manufactured material or combination of materials erected to enclose, screen, or separate areas.
   FLOODPLAIN. The channel and the relatively flat area adjoining the channel of a natural stream or river which has been or may be covered by floodwater.
   FLOOR AREA, RESIDENTIAL. For the purposes of computing the minimum allowable floor area in a residential dwelling unit, the sum of the horizontal areas of each story of the building measured from the exterior faces of the exterior wall. The floor area measurement is exclusive of areas of basements, attics, garages, breezeways, and porches.
   FOOD PROCESSING. The preparation, processing, or canning and packaging of food products.
   FRONTAGE. The minimum linear or curvilinear distance between the intersection of the side lot lines and the front lot line.
   GARAGE, PRIVATE. An accessory building designed or used for the storage of motor-driven vehicles owned and used by the occupants of the building to which it is accessory. Not more than one of the vehicles may be a commercial vehicle of more than two-ton capacity.
   GARAGE SALE. All general sales, open to the public, conducted from or on residential premises in any residential zone, as defined in the Zoning Code, for the purpose of disposing of personal property, including, but not limited to, all sales entitled "garage," "lawn," "yard," "attic," "porch," "room," "backyard," "patio," or "rummage" sale. The sale of personal property that is conducted on premises within a residential district upon which is located a dwelling.
   GAS STATION, SERVICE STATION. Any building, structure, or land used for the dispensing, and offering for retail sales automobile fuels, oils, or accessory services and including car washes. Does not include auto or motorized vehicle repair.
   GROUP HOME. A facility wherein: a) the operator is not legally related to the individuals supervised and is licensed by the federal, state, or county agency and wherein; b) one or more individuals is provided with room, board, specialized and distinctive care, and supervision in a family environment, or where five or more individuals reside and are provided with room, board, ordinary care, and supervision in a family environment.
   HIGHWAY, MAJOR. A street or road of considerable continuity and used primarily as a traffic artery for intercommunication among large areas.
   HOME OCCUPATION. An accessory use of a dwelling unit, conducted entirely within the dwelling unit, by one or more persons, all of whom reside within the dwelling unit, and where no persons are employed other than the resident and domestic help. The use may increase vehicular traffic flow and parking by no more than one additional vehicle at a time.
   HOMEOWNERS ASSOCIATION. A community association which is organized within a development in which individual owners share common interests and responsibilities for open space, landscape, or facilities.
   HOSPITAL. An institution where sick or injured persons are given medical care and, during same, are housed overnight, fed, and provided nursing, surgical and other related services.
   HOTEL. A building in which lodging or boarding and lodging are provided and offered to the public for compensation and in which ingress and egress to and from all rooms is made through an inside lobby or office supervised by a person in charge at all hours. As such, it is open to the public in contrast to a boarding house or a lodging house that are herein separately defined.
   INSTITUTIONAL. Buildings or land occupied by a nonprofit corporation or a nonprofit establishment for public use.
   LAND USE PLAN. The long-range plan for the desirable use of land in the area as adopted by the Planning Commission and Council; the purpose of such plan being, among other purposes, to serve as a guide in future development and zoning for the community.
   LANDSCAPE AREA. An area set aside from structures and parking which is developed with natural materials (i.e., lawns, trees, shrubs, vines, hedges, bedding plants, rock)
   LAW DIRECTOR, LEGAL COUNSEL. An attorney representing or appointed by Archbold, Ohio.
   LITTER. Litter includes, but is not limited to, any garbage, waste, peelings of vegetables or fruits, rubbish, ashes, cans, bottles, wire, paper, cartons, boxes, parts of automobiles, bicycles, wagons, furniture, glass, oil of an unsightly or unsanitary nature, or anything else of an unsightly or unsanitary nature.
   LOADING SPACE. A space within the main building or on the same lot therewith, providing for the standing, loading, or unloading of trucks and having a minimum dimension of 12 by 60 feet and a vertical clearance of at least 14 feet.
   LOT. A parcel of land occupied or intended for occupancy by a use permitted in this chapter, including one main building together with its accessory buildings, the open spaces and parking spaces required by this chapter, and having its principal frontage upon a street or upon an officially approved place.
   LOT COVERAGE. The area of a lot covered by structures or buildings, expressed as a percentage of the total lot area
   LOT, MINIMUM AREA OF. The area of a lot computed exclusive of any portion of the right-of-way of any public thoroughfare.
   LOT OF RECORD. A lot whose existence, location, and dimensions have been legally recorded or registered in a deed or on a plat.
   LOT WIDTH. The width of a lot at the building setback line measured at right angles to its depth.
   MANUFACTURED HOME. A building unit or assembly of closed construction that is fabricated in an off-site facility and constructed in conformance with the federal construction and safety standards established by the secretary of housing and urban development pursuant to the "Manufactured Housing Construction and Safety Standards Act of 1974," 88 Stat. 700, 42 U.S.C.A. 5401, 5403, and that has a permanent label or tag affixed to it, as specified in 42 U.S.C.A. 5415, certifying compliance with all applicable federal construction and safety standards.
   MANUFACTURED HOME PARKS. An area designed to accommodate manufactured homes and mobile homes in a safe, sanitary, and desirable manner as described in § 152.032.
   MANUFACTURING, GENERAL. Any manufacturing or industrial production which by the nature of the materials, equipment and process utilized are not objectionable by reason of odor, radiation, noise, vibration, gas fumes, dust, smoke, refuse matter or water-carried waste. Any manufacturing or industrial process permitted in an "M-2" District shall comply with the performance requirements of § 152.071, and the applicable regulation of the Ohio EPA.
   MANUFACTURING, RESTRICTED. Any manufacturing, employment, or industrial production which by the nature of the materials, equipment and process utilized are non-polluting, quiet, and free of any objectionable or hazardous element. Restricted industrial uses shall comply with the performance requirements specified in § 152.071, and the applicable regulation of the Ohio EPA, and may include processing and assembly of glass products, small household appliances, electronic products, and parts for production of finished equipment, research and testing laboratories, printing and engraving plants, commercial bakeries, and call centers.
   MARQUEE. A permanent structure, other than a roof or canopy, attached to, supported by, and projecting from a building and providing protection from the elements.
   MEDICAL OFFICE/CLINIC. A building or office designed and used for the diagnosis and treatment of human patients that does not include overnight care facilities.
   MINERAL EXTRACTION, STORAGE AND PROCESSING. Any mining, quarrying, or processing of limestone sand, gravel, or other mineral resources.
   MIXED USE. A tract of land or building or structure developed for two or more different uses such as, but not limited to, residential, office, manufacturing, retail, public, or entertainment.
   MOBILE HOME. A building unit or assembly of closed construction that is fabricated in an off-site facility, built on a permanent movable chassis which is eight feet or more in width and more than 35 feet in length, which when erected on site is 320 or more square feet, and is transportable in one or more sections and does not qualify as a manufactured home or industrialized unit as defined in R.C. § 3781.06.
   MODULAR UNIT. A building unit or assembly of closed construction fabricated in an off-site facility, as a structure or as a component(s) of a greater structure and that requires transportation to the site of intended use. Industrialized unit includes units installed on the site as independent units, as part of a group of units, or incorporated with standard construction methods to form a completed structural entity. Industrialized unit does not include a manufactured or mobile home as defined herein and shall meet the requirements of the Ohio Building Code or Ohio Residential Code
   MORTUARY. An establishment providing services such as preparing the human dead for burial and arranging and managing funerals and may include limited caretaker facilities.
   MOTEL. A building or series of buildings in which lodging is offered for compensation, and which is distinguished from a hotel primarily by reason of providing direct independent access to, and adjoining parking for, each rental unit.
   MOTOR VEHICLES. Any powered vehicle, which is required to be licensed by the state.
   MURAL. A large image which is painted, constructed, or affixed directly onto a vertical building wall, which shall not contain advertising with the exception of restored painted wall signs of a historic nature that may contain advertising.
   NONCOMMERCIAL RECREATIONAL FACILITIES. Private and semipublic recreational facilities which are not operated for commercial gain, including private country clubs, riding clubs, golf courses and other private noncommercial recreation areas and facilities or recreation centers including private community swimming pools.
   NONCONFORMING USE. The use of land or a building, or portion thereof, which does not conform to the use regulations of the district in which it is situated.
   OFFICE. A building or portion of a building where services are performed involving predominantly administrative, professional, or clerical operations.
   OFF-STREET PARKING SPACE. Any parking space located wholly off any street, alley, or sidewalk, either in an enclosed building or on an open lot, exclusive of access drives or aisles.
   OUTDOOR STORAGE. The keeping, in an unroofed area, of any goods, junk, material, merchandise, or vehicles in the same place for more than 24 hours.
   OUTDOOR WOOD-BURNING FURNACE. A freestanding accessory structure housing a wood-burning furnace, with a smokestack, used to provide heat or hot water to a building, other accessory structure, swimming pool or hot tub via liquid or other means. Said structure must include a smokestack height at least as high as the highest point of any roof of any residential building within 500 feet of the furnace. This definition does not include a fire pit, wood-fired barbecue or chimenea.
   PERSONAL SERVICES. Any enterprise conducted for gain, which primarily offers services to the public such as shoe repair, watch, repairing, barber shop, beauty parlors and similar activities.
   PLANNED DEVELOPMENT. A development of land that is under unified control and is planned and developed as a whole in a single development operation or programmed series of development stages. The development may include streets, circulation ways, utilities, buildings, open spaces, and other site features and improvements.
   PLANNING COMMISSION. The Planning Commission of Archbold.
   PLANT CULTIVATION. The cultivation of crops, fruit trees, nursery stock, truck garden products and similar plant materials outside or inside of structures, such as greenhouses.
   PROFESSIONAL OR ADMINISTRATIVE OFFICES. The use of offices and related spaces for such professional services as are provided by, lawyers, architects, engineers, real estate, financial services, and the like provided that no merchandising, retail, or wholesale is conducted on site
   PUBLIC SERVICE FACILITY. Buildings, power plants or substations, water treatment plants or pumping stations, sewage disposal or pumping plants and other similar public service structures owned by a public utility, by a railroad, whether publicly or privately owned, or by a municipal or other governmental agency, including the furnishing of electrical, gas, rail transport, communication, public water, and sewage disposal services, including publicly owned or leased administrative offices.
   RELIGIOUS INSTITUTIONS. A building, together with its accessory buildings and use, where persons regularly assemble for religious purposes and related social events. This includes parochial schools, churches, and other houses of worship.
   RESEARCH AND TESTING. Research, development, and testing laboratories that do not involve the mass manufacture, fabrication, processing, or sale of products. Such uses shall not violate any performance standards as established in this Zoning Code.
   RESIDENTIAL CARE FACILITY. A facility consisting of independent and semi-independent dwelling units, each occupied by not more than two residents per dwelling unit, aged 55 years or older; said facility shall have available on-site passive and active recreational facilities, supervised and unsupervised activities, housekeeping assistance, and full-time medical personnel to provide medical services, including but not limited to dietary and nutritional assistance and nursing care.
   RESTAURANTS AND BARS. A commercial establishment where food and/or beverages are prepared, served, and consumed primarily within the principal building.
   RETAIL SALES. Sale of commodities or goods in small quantities to ultimate consumers and is the industry of such selling.
   RIGHT-OF-WAY. A strip of land taken or dedicated for use as a public way. In addition to the roadway, it may include curbs, lawn strips, sidewalks, lighting, and drainage facilities, and may include special features (required by the topography or treatment) such as grade separation, landscaped areas, viaducts, and bridges which is public in nature.
   RV PARK. A parcel of land in which five or more campsites are designated for temporary occupancy by recreational vehicles for travel, recreational or vacation uses. Such parks shall be construed to include those parks having sites for tent camping as well as for RV campers. Also referred to as campgrounds.
   SELF-SERVICE STORAGE FACILITY. A building or group of buildings in a controlled access compound that contains varying sizes of individual, compartmentalized, and controlled access stalls or lockers for the storage of customer's goods or wares.
   SETBACK. The minimum distance from the back of sidewalk or public right-of-way line to the nearest point of the allowable principal building footprint.
   SIGN. Any device designated to inform or attract the attention of persons not on the premises on which the sign is located. Sign types are defined in § 152.101
   SIGN, ADVERTISING. A sign, which directs attention to a business, profession, commodity, or entertainment, conducted, sold, or offered elsewhere than upon the same lot.
   SIGN, ILLUMINATED. Any sign illuminated by electricity, gas, or other artificial light including reflecting or phosphorescent light.
   SITE PLAN. A plan, to scale, showing uses and structures proposed for a parcel of land as required by the regulations of this Zoning Code. It includes lot lines, streets, building sites, reserved open spaces, buildings, major landscape features and locations of proposed and existing utility lines and other items as requested by municipal staff.
   SITE PLAN REVIEW. The process whereby municipal staff or the Planning Commission shall review the site plans and maps of a development to assure that they meet the stated purposes and standards of the zoning district, provide for the necessary public facilities, protect, and preserve topographical features and adjacent properties through appropriate siting of structures and landscaping.
   SOLAR ENERGY GENERATION (SYSTEM). Solar collection equipment and structural design features that rely upon sunshine as an energy source and is capable of collecting, distributing, and storing (if appropriate to the technology) the sun's radiant energy for a beneficial use.
   STRUCTURAL ALTERATIONS. Any change which would tend to prolong the life of a supporting member of a structure such as bearing walls, columns, beams, or girders.
   STRUCTURE. Anything constructed or erected, the use of which requires location on the ground or attached to something having a permanent location on the ground, including — but without limiting — sheds, pergolas, and buildings.
   TELECOMMUNICATIONS TOWER. A tower, pole, or similar structure that supports a telecommunications antenna operated for commercial purpose above ground in a fixed location, freestanding, guyed, or on a building or other structures.
   TOURIST HOME. A building other than a hotel where lodging is provided and offered to the public for compensation for not more than ten individuals, including the serving of breakfast. A tourist home can be classified as a bed & breakfast facility.
   TRAILER, SMALL UTILITY. Any trailer drawn by a truck or automobile, used for the occasional transport of personal effects.
   TRANSPORTATION, TERMINALS AND STORAGE. Freight terminals, including loading docks, storage, wholesale distribution, and cold storage; intended for distribution. Does not include self-service storage or warehouse.
   VARIANCE. A relaxation of requirements where such variation will not be contrary to the public interest and where, owing to conditions peculiar to the property, a literal enforcement of this chapter would result in unnecessary and undue hardship.
   WAREHOUSE. A building used primarily for the storage of goods and materials.
   WIND ENERGY GENERATION (SYSTEM). Any mechanism or device designed for the purpose of converting wind energy into electrical or mechanical power.
   YARD. An open space at grade between a primary building and the adjoining lot lines. In measuring a yard for determining the width of a side yard, the depth or area of a front yard or rear yard, the horizontal distance between the lot line and the main building shall be used.
   YARD, FRONT CORNER LOTS. A yard located on a lot having frontage on more than one street.
   ZERO LOT LINE DWELLING. An arrangement of single family, detached, dwelling units on which one or more of the buildings sides sits on the lot line. No building or structure hall have less than a five-foot separation.
   ZONING DISTRICT MAP. The Official Zoning District Map together with all amendments subsequently adopted.
   ZONING INSPECTOR. The authorized representative appointed by the Planning Director, Administrator or Council to uphold the regulations of the Zoning Code.
   ZONING PERMIT. The document issued by the Zoning Inspector or designee authorizing the use of the land or buildings.
