§ 70.05 APPLICATION TO PUBLIC OFFICIALS AND EMPLOYEES.
   (A)   Public officials and employees.
      (1)   The provisions of this traffic code shall apply to the driver of any vehicle owned by or used in the service of the federal government and any state, county, municipality, or other governmental unit or agency as well as to other vehicles; it shall be unlawful for any said driver to violate any of the provisions of this traffic code, except as otherwise permitted herein or by state laws.
      (2)   This traffic code shall not apply to the military forces of the United States and organizations of the National Guard when performing military duty.

   (B)   Persons working on streets.
      (1)   Unless specifically made applicable, the provisions of this traffic code, except those relating to reckless driving and driving while intoxicated, shall not apply to persons, teams, motor vehicles, and other equipment while actually engaged in work upon the surface of a street or to persons, motor vehicles, and other equipment while actually engaged in construction, maintenance, or repair of public utilities; provided, all highway and public utility operations shall be protected by adequate warning signs, signals, devices, or flaggers.
      (2)   However, the provisions of this traffic code shall apply to such persons and vehicles when traveling to or from such work.
