§ 52.018 RATE SETTING.
   (A)   Each user shall pay for the services provided by the municipality. Payment shall be in accordance with the schedule set below.
   (B)   The following classes of users and charges to those users are hereby established:
 
Class I
Residential users: single family contributors
$16/month for operation and maintenance, including replacement, plus $0.20/1000 gal. (per winter water usage average)
Class II
Industrial/commercial users: users which contribute greater volume or greater than normal wastewater strength
$16/month for operation and maintenance, including replacement, plus $0.20/1000 gal. (water use per month)
 
   (C)   Any user which discharges any toxic pollutants which cause an increase in the cost of managing the effluent or the sludge from the municipality’s treatment works, or any user which discharges any substance which singly or by interaction with other substances causes identifiable increases in the cost of operation, maintenance or replacement of the treatment works, shall pay for such increased costs. The charge to each such user will be as determined by the responsible plant operating personnel and approved by the City Council.
   (D)   The user charge rates established in this chapter apply to all users, regardless of their location, of the municipality’s treatment works.
   (E)   This section shall take precedence over any terms or conditions of agreements or contracts between the municipality and a user which are consistent with current federal regulations promulgated under § 204 (b)(1)(A) of the Clean Water Act, being 33 USC 1284.
   (F)   In accordance with this section, the municipality may at its own discretion, require a user to pay the cost of installing a monitoring manhole on their discharge line(s) to enable the municipality to adequately determine both strength and volume of discharge from the user. Said monitoring manhole shall be installed under the direction of the Utilities Superintendent and should be located in the public right-of-way where possible. Where not possible, user shall grant the municipality right of access to the monitoring manhole.
